陳水扁因為4大案件在一審被判無期徒刑，高院二審改判20年，全案上訴到最高法院後，最高法院囑託高院合議庭開移審庭，高院7月間裁定羈押扁3個月，期限到10月18日期滿。
高院合議庭10月1日召開延押庭時，陳水扁說，扁家在瑞士的現金、有價證券已經全數匯回，款項數字和檢方認定有差距，「是因有價證券的鑑價及提前解約而有利差、虧損」。
合議庭指出，特偵組原本認定海外款有2242.5萬美元，但目前僅匯回1841萬1856美元，還有300多萬美元的差距，陳水扁口頭上說已經全數匯回，但完全無法證明海外帳戶已經沒有遺產留存，「加上扁涉犯重罪，有逃亡之虞，羈押理由未消滅」，因此裁定延押。
據悉，今(7日)已是陳水扁被羈押680天，如今裁定延押2個月，等於無法在五都選舉前被釋放，10月9日的生日也只能在牢中度過。
